1. Acceptance of Terms

By accessing or using the Validus Health mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App. These Terms constitute a legally binding agreement between you and Validus Health.

2. Description of Service

Validus Health is a mobile application that provides ingredient-level food scoring and analysis through barcode scanning. The App uses a science-based scoring engine grounded in peer-reviewed nutrition science and whole-body, root-cause scoring rules to analyze product information and provide educational information. The App is for informational purposes only and does not provide medical advice, diagnosis, or treatment.

3. User Accounts and Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years old. You may create an account or use the App as a guest. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to: (a) use the App in any way that violates any applicable law or regulation; (b) transmit any malicious code or viruses; (c) attempt to gain unauthorized access to the App or its systems; (d) interfere with or disrupt the App or servers; or (e) use the App to infringe upon the rights of others.

5. Health Information Disclaimer

THE APP PROVIDES INFORMATIONAL CONTENT ONLY AND DOES NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The health scores, recommendations, and analysis provided by the App are based on general nutritional information and should not be used as a substitute for professional medical advice. Always consult with a qualified healthcare provider before making decisions about your health, diet, or nutrition. The App is not intended to diagnose, treat, cure, or prevent any disease.

6. Intellectual Property

The App and its content, including but not limited to text, graphics, logos, images, and software, are the property of Validus Health or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without prior written permission from Validus Health.

7. User Content

You retain ownership of any content you submit to the App, including scan history and personal information. By submitting content, you grant Validus Health a non-exclusive, worldwide, royalty-free license to use, store, and process your content to provide and improve the App services. You represent that you have the right to grant this license.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VALIDUS HEALTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. THE TOTAL LIABILITY OF VALIDUS HEALTH SHALL NOT EXCEED THE AMOUNT YOU PAID TO VALIDUS HEALTH IN THE TWELVE MONTHS PRIOR TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Validus Health, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or violation of these Terms.

10. Termination

Validus Health may terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. You may terminate your account at any time by contacting us at support@validushealth.ai.

11. Changes to Terms

Validus Health reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App or by other means. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App.
